OSHA cites, fines Disney in fatal July monorail accident



Mouse Planet is reporting on OSHA results of "accidents" that have plagued Disney this year.

I am finding it difficult to believe Disney is not admitting fault considering the OSHA report above. Surprised no.

MousePlanet: …Walt Disney World filed its response to the civil lawsuit brought by the mother of monorail pilot Austin Wuennenberg who was killed in a crash involving two monorails last July 5 at Magic Kingdom. Disney has not admitted any fault in the accident and has requested a jury trial.

That would be bad enough. Now Disney wants a Jury Trial. Seriously???
Really??? That is very unfortunate they have chosen to put the mother through a Jury Trial.

Can't imagine this trial will make Disney look good no matter how their attorney's spin it. Ahhhhhh!

I just re-read the report, more angry with the Disney higher ups that decided this is the appropriate way to handle the death of this young man.

Read a few more stories since, haven't found one that is supporting Disney's request for a Jury Trial.

I'm guessing it is a legal thing, done by lawyers, for lawyers.

The OSHA report is not necessarily a legal finding. That can be submitted as evidence, however.

If Disney came out and admitted fault, they would not have a position to negotiate a settlement, etc.

I'd think they would just settle. Head dude off campus eating, no one in tower, another not following procedure in barn. Not following manual.
Nobody to fill in for sick employee.

Why would they wish to re-air this all in a jury trial?

I tend to agree - don't see how they are going to have a jury trial without getting their hands even more dirty. Austin's mom deserves better than to have to drag this out through a jury trial. There are so many media outlets that already jump at the chance to sensationalize any Disney scandal, how is this going to make anything better for anyone?
